PRIVACY POLICY

Fusion Sports Ventures, LLC (“Fusion Sports,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy describes how we collect, use, disclose, and safeguard personal information when you or your child interact with our websites, mobile applications, digital platforms (including Fusion Passport), tournaments, festivals, training programs, and related services (collectively, the “Services”).
By accessing or using the Services, registering for an event, or providing personal information to us, you acknowledge that you have read and understood this Privacy Policy. If you do not agree with our practices, please do not use the Services.
Parents and legal guardians: If you are registering a minor, you represent that you are the parent or legal guardian of that minor and that you consent to the collection and use of the minor’s information as described in this Policy.
1. Scope of This Policy
This Policy applies to information collected through:
- Our public websites and any Fusion Sports-branded web properties;
- The Fusion Passport digital engagement platform, including QR/NFC-based interactions;
- Event registration portals, including third-party platforms we use such as GotSport and PlayMetrics;
- Our performance and training applications;
- In-person interactions at tournaments, Fusion Festival events, clinics, and activations;
- Marketing, promotional, and sponsor engagement campaigns; and
- Communications with us via email, phone, text message, or social media.
This Policy does not cover the privacy practices of third parties that are not owned or controlled by Fusion Sports, even where such third parties are integrated with or linked from our Services. See Section 10 (Third-Party Platforms and Links).
2. Information We Collect
We collect the following categories of personal information:
2.1 Identifiers and Contact Information
- Full name, date of birth, gender (where relevant to age-division placement), mailing address, email address, telephone number.
- For minors: name, date of birth, gender, jersey size, team affiliation, club, and age division.
- Parent/guardian name and contact information associated with minor participants.
- Emergency contact name, relationship, and telephone number.
2.2 Participant and Roster Information
- Player position, team, club, coach, uniform number, years of experience, skill level, and tournament history.
- Photographs and video captured at events, training sessions, or provided during registration (see Section 7 regarding media).
- Performance data collected through our training applications (e.g., drills completed, metrics, progress tracking).
2.3 Health and Safety Information
- Limited medical information voluntarily disclosed to facilitate safe participation (e.g., allergies, asthma, concussion history, medications, physician contact). This information is collected to protect participant safety and is not used for marketing.
- Incident and injury reports created in connection with participation.
2.4 Payment Information
Fusion Sports does not directly store full payment card numbers. Payments are processed by PCI-DSS compliant third-party payment processors (credit card and ACH). We receive limited transaction data such as transaction ID, amount, last four digits of the card, cardholder name, and billing ZIP code.
2.5 Device, Usage, and Technical Information
- IP address, device identifiers, browser type and version, operating system, referring URLs, pages visited, session duration, and timestamps.
- Data from cookies, web beacons, pixels, and similar tracking technologies (see Section 5).
- Location information derived from IP address or (with permission) precise geolocation from your device when using Fusion Passport features.
2.6 Engagement and Promotional Data
- Fusion Passport scan history, check-ins, redemptions, points, rewards, sponsor activations completed, and promotional code usage.
- Survey responses, feedback, contest entries, and communications with our staff.
2.7 Information from Third Parties
- Data from event registration platforms such as GotSport and PlayMetrics when you register through those systems.
- Information from sponsors or partners when you opt in to a joint promotion or activation.
- Publicly available information and data from social media platforms when you interact with our accounts or content.
2.8 Health and Fitness Data
Our performance and training applications collect and process health- and fitness-related information, which may include workout activity, exercise logs, heart rate, and other fitness metrics (collectively, “Health Data”). Health Data is collected only with your explicit, opt-in consent, and is used exclusively to deliver core features of the Services, including fitness tracking, progress insights, and cross-device synchronization of your account.
We do not sell Health Data, do not share Health Data with unaffiliated third parties for their own purposes, and do not use Health Data for advertising or marketing. Health Data may be processed by limited-purpose service providers (such as cloud hosting and security vendors) strictly to operate and secure the Services, under written agreements that restrict their use of the data to those purposes.
Health Data is stored using commercially reasonable administrative, technical, and physical safeguards. Access is limited to authorized personnel with a legitimate operational need. You may withdraw consent to the collection or processing of Health Data at any time through your in-app settings or by contacting us at [Company Contact Email]; withdrawal may limit or disable certain features that depend on Health Data.
If you delete your account in accordance with Section 13, your Health Data will be deleted in accordance with the deletion process and exceptions described in that Section.
Note on HIPAA: Fusion Sports is not a “covered entity” or “business associate” under the Health Insurance Portability and Accountability Act (HIPAA), and Health Data collected through the Services is not “protected health information” governed by HIPAA. Certain state laws, however, may apply to consumer health data; where they do, we honor the rights those laws provide.
3. How We Collect Information
- Directly from you or your parent/guardian through registration forms, account creation, waivers, surveys, and on-site sign-ups;
- Through third-party registration and management platforms (GotSport, PlayMetrics) that we license to administer tournaments and club operations;
- Through our website (hosted on Squarespace) and its built-in analytics and form-handling tools;
- Through cookies, SDKs, and analytics tools embedded in our digital properties;
- Through Fusion Passport QR/NFC scans, redemptions, and engagement interactions at events;
- Through photography, videography, and recording at events (see Section 7);
- From sponsors, partners, clubs, or referees that share information for a legitimate operational purpose; and
- Automatically when you communicate with us, including SMS, email, and phone.
4. How We Use Information
We use the information we collect for the following purposes:
- Event and Program Operations: registering participants, placing teams in divisions, managing schedules, verifying eligibility, issuing credentials, processing refunds where applicable, and communicating logistical information.
- Platform Operations: creating and maintaining accounts, enabling Fusion Passport features, delivering training-app functionality, and providing customer support.
- Communications: sending transactional messages (confirmations, schedules, weather alerts, safety notices), responding to inquiries, and delivering service updates via email, SMS, and in-app notifications.
- Marketing and Promotions: sending newsletters, event announcements, Fusion Festival invitations, and promotional offers (with opt-out rights as described in Section 6).
- Sponsor Activations: delivering sponsor campaigns, redemptions, and engagement experiences. We share only the information necessary for the specific activation and do not sell sensitive personal information to sponsors.
- Safety and Medical Response: responding to on-site medical situations, contacting emergency contacts, documenting incidents, and protecting participants, staff, and attendees.
- Analytics and Improvement: understanding how the Services are used, improving user experience, developing new features, and measuring event and campaign effectiveness.
- Legal, Safety, and Compliance: complying with applicable law, responding to lawful requests, enforcing our Terms and Conditions, detecting and preventing fraud or misuse, and protecting our rights and the rights and safety of others.
- With Your Consent: for any other purpose disclosed to you at the time of collection or to which you consent.
5. Cookies and Tracking Technologies
We and our service providers use cookies, pixels, web beacons, SDKs, and similar technologies to operate and analyze the Services.
5.1 Types of Technologies
- Strictly Necessary: required for core functionality such as logging in, registering, or processing payments.
- Analytics: help us understand visitor behavior (e.g., pages viewed, time on site). We may use tools such as Google Analytics, Squarespace Analytics, and similar.
- Functional: remember preferences and personalize your experience.
- Marketing and Advertising: measure the effectiveness of our campaigns and, where applicable, deliver relevant advertising.
5.2 Your Choices
Most browsers allow you to refuse or delete cookies. You may also adjust mobile device settings to limit ad tracking. Disabling cookies may impair some features of the Services. We respond to Global Privacy Control (GPC) signals to the extent required by applicable law.
5.3 Do Not Track
Because industry standards for “Do Not Track” (DNT) signals are not settled, we do not currently respond to DNT browser signals. We do honor applicable opt-out signals such as GPC where required by law.
6. Email, SMS, and Other Communications
6.1 Transactional Messages
We send operational messages relating to your registration, event logistics, payment receipts, safety, and account activity. These messages are necessary for the Services and are not subject to marketing opt-out.
6.2 Marketing Emails
You may unsubscribe from marketing emails at any time by clicking the “unsubscribe” link in the email footer or by emailing info@fusionsportsventures.com.
6.3 SMS / Text Messaging
By providing your mobile number, you consent to receive SMS/text messages from Fusion Sports relating to events, schedules, safety alerts, and, where separately authorized, marketing or promotional content. Message and data rates may apply. Message frequency varies. Reply STOP to unsubscribe or HELP for help. Opting out of marketing SMS will not affect transactional safety or logistics messages required for event participation.
We comply with the Telephone Consumer Protection Act (TCPA) and applicable CTIA guidelines. We do not share mobile opt-in data or consent with third parties for their own marketing purposes.
7. Photography, Video, and Likeness
Fusion Sports events are often photographed and recorded. By attending or participating, you acknowledge that you, your minor participant, or your companions may appear in photos, video, livestreams, or other media captured at the event.
By registering for or attending an event, you grant Fusion Sports and its authorized sponsors and partners a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, edit, display, and distribute such media for promotional, editorial, commercial, and sponsor-activation purposes in all media now known or later developed. This license is addressed in greater detail in our Terms and Conditions.
If you wish to request removal of a specific image or recording, contact us at info@fusionsportsventures.com. We will make reasonable efforts to comply with such requests but cannot guarantee removal from third-party platforms or previously distributed materials.
8. How We Share Information
We share personal information only as described below. We do not sell sensitive personal information, and we do not sell personal information of known minors under 16 without affirmative authorization.
8.1 Service Providers
We share information with vendors that perform services on our behalf, including:
- Event and club management: GotSport, PlayMetrics.
- Website and hosting: Squarespace.
- Payments: PCI-DSS compliant credit card and ACH processors.
- Communications: email service providers, SMS gateways, customer support platforms.
- Analytics and advertising: as described in Section 5.
- Professional advisors: auditors, attorneys, insurers, and consultants.
Service providers are contractually obligated to use personal information only for the purposes we specify and to protect it appropriately.
8.2 Sponsors and Partners
When you participate in a sponsor activation, redeem a sponsor offer through Fusion Passport, or enter a co-branded promotion, limited information (such as name, email, and participation data relevant to the activation) may be shared with the applicable sponsor or partner. Where required by law, we will obtain your consent before such sharing.
8.3 Clubs, Teams, and Tournament Organizers
We may share roster, schedule, and eligibility information with clubs, coaches, referees, officials, and affiliated organizations to administer events.
8.4 Legal Requirements and Protection of Rights
We may disclose information when we believe in good faith that disclosure is necessary to (i) comply with law, legal process, or government requests; (ii) enforce our Terms and Conditions; (iii) protect the rights, property, or safety of Fusion Sports, our users, participants, or others; or (iv) detect, prevent, or address fraud, security, or technical issues.
8.5 Business Transfers
If Fusion Sports is involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, personal information may be transferred as part of that transaction, subject to standard confidentiality protections.
8.6 With Your Consent or at Your Direction
We may share information for any other purpose with your consent or at your direction.
8.7 No Sale of Sensitive Personal Information
Fusion Sports does not sell sensitive personal information (as defined under the CCPA/CPRA and comparable state laws), and does not knowingly sell the personal information of consumers under 16 years of age without affirmative authorization.
9. Children’s Privacy
Fusion Sports is designed for youth sports participation. Accounts for participants under the age of 13 are created, managed, and consented to by a parent or legal guardian (“Parent”).
Consistent with the Children’s Online Privacy Protection Act (COPPA), we:
- Collect from children under 13 only the information reasonably necessary to register for and participate in events, training, and engagement activities, and only after obtaining verifiable parental consent;
- Do not condition a child’s participation on the disclosure of more personal information than is reasonably necessary;
- Do not use children’s personal information for targeted advertising;
- Do not knowingly sell the personal information of children; and
- Retain children’s information only as long as reasonably necessary for the purpose collected, then delete or de-identify it.
Parents may review, correct, or request deletion of their child’s personal information at any time by contacting info@fusionsportsventures.com. Parents may also refuse to permit further collection or use of their child’s information, understanding that some features may then be unavailable.
10. Third-Party Platforms, Integrations, and Links
The Services integrate with and link to platforms operated by third parties, including GotSport, PlayMetrics, Squarespace, payment processors, and sponsor sites. These third parties have their own privacy practices and policies. We are not responsible for the content, privacy practices, or security of third-party platforms. We encourage you to review their policies before submitting personal information.
To the fullest extent permitted by law, Fusion Sports disclaims liability for the acts or omissions of third-party platforms and for any data processing that occurs under their control.
11. Data Retention
We retain personal information for as long as reasonably necessary to fulfill the purposes described in this Policy, including:
- Participant registration records: for the duration of the event season and for up to seven (7) years thereafter, to support accounting, liability, insurance, and statute-of-limitations considerations;
- Waivers, medical authorizations, and incident reports: for the longest statute of limitations applicable in any state in which we operate, plus a reasonable buffer;
- Marketing and engagement data: until you opt out or the data is no longer reasonably useful;
- Transaction and payment records: as required by tax, accounting, and financial laws; and
- Aggregated or de-identified data: indefinitely, in a form that cannot be reasonably associated with you.
When retention is no longer required, we will delete, destroy, or de-identify the information using reasonable measures.
12. Data Security
Fusion Sports implements reasonable administrative, technical, and physical safeguards designed to protect personal information from unauthorized access, use, alteration, and disclosure. These measures include access controls, encryption in transit for sensitive data, vendor due diligence, and employee confidentiality obligations.
However, no method of transmission over the Internet or method of electronic storage is 100% secure. To the fullest extent permitted by law, Fusion Sports disclaims liability for unauthorized access to or disclosure of personal information that occurs despite our reasonable safeguards, including breaches caused by third-party service providers, payment processors, or platforms outside our control. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
13. Your Privacy Rights
Subject to applicable law, you may have the following rights regarding your personal information:
- Right to Know / Access: request confirmation of whether we process your personal information and obtain a copy of that information.
- Right to Correct: request correction of inaccurate personal information.
- Right to Delete: request deletion of personal information, subject to legal exceptions.
- Right to Portability: request your information in a portable format.
- Right to Opt Out of Sale or Sharing: Fusion Sports does not sell or share personal information for cross-context behavioral advertising. You may still submit a request.
- Right to Limit Use of Sensitive Personal Information: request that we limit use of sensitive personal information to specified purposes.
- Right to Non-Discrimination: exercise your rights without receiving discriminatory treatment.
13.1 How to Exercise Your Rights
Submit requests to info@fusionsportsventures.com with the subject line “Privacy Rights Request.” We will verify your identity using reasonable methods proportionate to the sensitivity of the information and the request. We aim to respond within the time frames required by applicable law (generally 45 days, extendable as permitted).
13.2 Authorized Agents
You may designate an authorized agent to submit a request on your behalf. We will require written proof of authorization and may require direct verification with you.
13.3 Appeals
If we decline your request, you may appeal by replying to our response or writing to info@fusionsportsventures.com with the subject line “Privacy Appeal.” We will respond to appeals within the time frame required by the law applicable to your state of residence.
13.4 Account Deletion
You may request deletion of your account and associated personal information, including any Health Data described in Section 2.8, in either of the following ways:
- Through the in-app settings of the applicable Fusion Sports application; or
- By submitting a written request through our contact form or by email to info@fusionsportsventures.com, with the subject line “delete my account”, and including in the body of the message your first and last name and the email address associated with your account.
We will use commercially reasonable efforts to process verified deletion requests promptly and, in any event, within the time frames required by applicable law.
Exceptions and retained records. As permitted by applicable law, we may retain an archived copy of certain records where necessary to: (i) comply with legal, tax, accounting, insurance, or regulatory obligations; (ii) establish, exercise, or defend legal claims (including claims relating to sports participation, injury, or event liability, consistent with the retention periods in Section 11); (iii) detect and prevent fraud or security incidents; or (iv) complete transactions or provide services you have requested.
Communications and posted content. Please note that communications you send to us through the Services, as well as any comments, posts, reviews, or user submissions you make publicly or to shared areas of the Services, may be stored in our records or displayed publicly and may not be subject to modification or deletion upon account closure. If you wish to request removal of specific public content, contact us at info@fusionsportsventures.com and we will make reasonable efforts to comply, subject to applicable law.
13.5 Browser and Device Controls
Independently of any account-level request, you may control certain information we collect through settings on your browser or mobile device:
- You may configure your browser to reject cookies from the Services, or to prompt you before accepting cookies;
- You may adjust your mobile device settings to prevent the Services from obtaining precise location information; and
- You may manage notification, tracking, and permissions through your device’s operating system.
Please note that the Services may rely on cookies and location information to function properly, and certain features may be unavailable or degraded if you disable these technologies.
14. State-Specific Disclosures
14.1 California (CCPA/CPRA)
In the preceding 12 months, we have collected the categories of personal information described in Section 2 (Identifiers; Customer Records information; Characteristics of protected classifications such as age; Commercial information; Internet/electronic network activity; Geolocation data; Audio/visual information; Professional or employment-related information where applicable; and Inferences). We collect this information from the sources in Section 3 for the purposes in Section 4 and share it with the categories of recipients in Section 8.
We do not sell personal information for money. We do not engage in “sharing” for cross-context behavioral advertising as defined by the CPRA. We do not knowingly sell or share the personal information of consumers under 16 years of age.
California residents have the rights in Section 13 and may submit verifiable consumer requests to [Company Contact Email]. California residents may also request disclosure of certain categories of personal information shared with third parties for direct-marketing purposes under California’s “Shine the Light” law.
14.2 Other U.S. State Privacy Laws
Residents of other U.S. states with comprehensive privacy laws (including, as of the date of this Policy, Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, Delaware, Iowa, Tennessee, New Jersey, Minnesota, Maryland, Indiana, Nebraska, and Rhode Island, among others) have similar rights to access, correct, delete, and obtain portable copies of personal information, and to opt out of targeted advertising, sale, and certain profiling. Exercise these rights by contacting info@fusionsportsventures.com.
14.3 Nevada
Nevada residents may submit a verified request that we not sell their covered personal information to info@fusionsportsventures.com. Fusion Sports does not currently sell personal information as defined by Nevada law.
15. U.S. Operations; Users Outside the United States
The Services are intended for use within the United States. If you access the Services from outside the United States, you acknowledge that your information will be transferred to, stored, and processed in the United States, which may have data protection laws different from those of your home country.
16. Changes to This Policy
We may update this Policy from time to time. When we make material changes, we will post the updated Policy on our website and update the “Last Updated” date. We may also notify you by email or through the Services. Your continued use of the Services after the effective date of the updated Policy constitutes acceptance of the changes.
